Spodi Terms of Service

1. Definitions

Operator — Individual Entrepreneur Gulyaev Maksim Yuryevich, OGRNIP 326527500032500, INN 524613147662, 606440, Russia, Nizhny Novgorod region, Bor.

Service — the website spodi.ru, its web app, and the Spodi app for iOS.

User — an individual registered with the Service.

2. Service Description

Spodi is a workout diary for logging exercises, tracking progress, creating templates, and viewing statistics.

3. Registration and Account

  • Registration is required to use the Spodi service.
  • The User undertakes to provide accurate information.
  • One User may hold only one account in the Service. Registering several accounts by one User, as well as handing access to an account to third parties, is not permitted.
  • The User is responsible for keeping their credentials safe.
  • The Service contains no information that may harm the health or development of children (age rating 0+). Registration is available to persons of full civil capacity, or to minors with the consent of their legal representatives under Articles 26 and 28 of the Civil Code of the Russian Federation.

4. User Obligations

The User must:

  • provide accurate information at registration and while using the Service, including profile data (gender, date of birth, height, body weight);
  • assess their own state of health and, where necessary, consult a doctor before starting to train;
  • keep their sign-in credentials confidential;
  • when uploading videos, not infringe the rights of third parties who may appear in the frame;
  • not distribute illegal content through the Service;
  • not attempt unauthorised access to the Service, including by means of automated tools (bots, scrapers) or by circumventing technical restrictions.

5. Intellectual Property

The Service (including its source code, design, trademarks, databases and other objects) is the intellectual property of the Operator. The Operator grants the User a simple non-exclusive licence to use the Service in accordance with its intended purpose.

The User may not copy, reproduce, distribute or modify the Service or any of its elements, nor decompile or reverse-engineer them.

Workout data, including videos, belongs to the User. By uploading videos to the Service, the User grants the Operator the right to store and process them to the extent needed to provide the Service's functionality (including showing them to a coach while a coach-client link is active).

6. Subscription

Basic functionality of the Service is free. Some features are provided under the Spodi Premium subscription. Its price and the rules for payment, automatic renewal, cancellation and refunds are set out in the public offer at spodi.ru/offer, which forms an integral part of these Terms with respect to paid services.

7. Availability

We aim for continuous availability but do not guarantee 100% uptime.

8. Limitation of Liability

The Service is not a medical tool. Consult a doctor before starting any training program.

9. Account Termination

  • The User may delete their account via profile settings;
  • The User's account may be blocked for violating the terms of use of the Service;
  • After the account is deleted, the data needed to provide the Service is erased within 30 days at the latest. Payment records are kept separately for the period prescribed by law — see the Privacy Policy.

10. Governing Law

Governed by the laws of the Russian Federation.

11. Dispute Resolution

Through negotiation, then courts at the operator's location.

12. Changes

The Operator may amend these Terms. A new revision is published at spodi.ru/terms and applies from the effective date stated in it. The Operator notifies Users of material changes through the Service (a push notification or an in-app banner) before they take effect. Continued use of the Service after a new revision takes effect constitutes the User's acceptance of the changes.

Personal data needed to perform these Terms is processed on the basis of these Terms. How data is processed, and the cases where separate consent is required, are described in the Privacy Policy.
